Sec 239(2) of the RMA states: "...land may be vested subject to any specified interest which the territorial authority has certified, on the survey plan, shall remain with the land".
The Landonline e-certification template reads: "..hereby certify that the _____ Council desires that Lot __ Plan __ which is to vest as reserve shall remain subject to the right of way created by ___"
For some reason the Landonline template restricts the certification to rights of way. The occasions when we've had to gain 239(2) certification have related to encumberances other than rights of way, so the online template isn't applicable and we've had to revert to the old manual paper certification process for those.
It would be helpful if that inconsistency could be rectified.
