I have submitted an e-dealing with the name spelt incorrectly on the transfer instrument. The name was also wrong on the mortgage instrument! What should I do?

  1. Register a correction of name (as you would if you made a similar mistake in the paper environment); or
  2. If the mortgagee is a private individual, register a discharge and a new mortgage in the correct name. The original A&I will be sufficient authority. Attach a statutory declaration outlining the error and steps taken to correct it.
  3. If the mortgagee is a bank and the bank requires a new corrected mortgage, a letter from the bank is required to register the discharge and new mortgage.

I am setting up an e-dealing – I've noticed that my client's name is spelt incorrectly on the title? Do we have to get this corrected or can we just attach a declaration to the A&I form?

  1. A change or correction of name can now be registered by e-dealing, to show the client's name correctly in the register and in new e-dealing transactions. The practitioner will need to hold an A&I form and other documentation as set out in LINZG20704 Guideline for making application to change or correct names on the Register - (PDF 274KB).
  2. If the client is disposing of an interest, then it may not be necessary to change or correct the name in the register. Supporting documentation as set out in LINZG20704 Guideline for making application to change or correct names on the Register - (PDF 274KB) attached to the A&I form would suffice.
