Release 3.1 roadshow draws to a close

Our training team recently completed the Release 3.1 roadshow delivering the latest e-dealing changes to more than 2,300 conveyancing professionals at 18 locations around New Zealand. Feedback from the 30 presentations and 46 practical workshops has been positive.

Katrina Davidson from Ronald W Angland & Son (Leeston) found the presentation useful. "I'm now better prepared to deal with transactions that I was previously unsure how to do via e-dealing. Thanks for all your efforts to make my job easier."

The practical workshops were well received with over 1,400 people attending a workshop in their area. Workshop participants used the e-dealing Practice Tool, which is available on this website.

Robyn Clark from Baker MacCullum attended one of the workshops. "I found the practical workshop very informative and being able to use the e-dealing Practice Tool was beneficial."

Release 3.1 is the last Landonline release before 100% e-lodgement. We encourage you to submit all e-capable instruments by e-dealing in preparation for mandatory, which is only four months away on 23 February 2009.

As Release 3.1 introduces Image Only options, the need for scanning has increased. If the document being attached to your instrument is electronic but not in TIFF or PDF format, it will need to be converted to TIFF. You can download the Print-to-TIFF software from this website.

If the document you wish to attach is in paper format, you need to scan it and then convert the document to TIFF. Some scanners have the option of scanning to TIFF. Click here for further information on scanners and the requirements.

e-dealing... how far we have come

As you know, Release 3.1 is the last release of Landonline before 100% e-lodgement becomes mandatory on 23 February 2009. We have all come a long way since March 2006 when the announcement was made that electronic lodgement of titles transactions would become mandatory.

The thought of changing New Zealand's Land Title Register to be 100% electronic was daunting to say the least. Understandably, there were lots of concerns surrounding how LINZ would introduce this new system, how stable would it be, and how LINZ would make sure people were trained.

Nola McGowan, a partner at Vlatkovich & McGowan says, "I was extremely apprehensive about e-dealing back in April and I still feel a bit nervous when completing a transaction. I was concerned about the amount of extra work I'd have to do along with how the documents would be stored at the firm. Attending the presentations really helped me get over my apprehension, and clarified questions I have had regarding e-dealing. I gained some valuable information."

Generally, during the past two years these concerns have been alleviated. LINZ has completed national roadshows for each of the three releases and customers have seen for themselves how intuitive Landonline is and how easy it is to submit dealings electronically.

LINZ has had a lot of help from Duncan Terris, Property Law Section representative, who has been involved in the design and build of e-dealing. "There's been a huge pendulum swing in attitudes from five years ago. People now see that Landonline isn't so bad after all," says Duncan.

Feedback from those who attended the Release 3.1 roadshow has been overwhelming, with many excited about being able to do the majority of their land transactions by e-dealing.

The support and confidence customers have shown LINZ over the past two years has been remarkable and we know that this will continue as Landonline is enhanced in the future.

Get ready for 100% e-lodgement

You have four months to get ready for 100% e-lodgement and should now be using e-dealing to submit your transactions wherever you can. We have published a full list of e-capable instruments on this website.

Multiple mortgagees/encumbrances

Where there are multiple mortgagees/encumbrancees, the name of each mortgagee or encumbrancee needs to be entered in separate lines. This will ensure that any variations or discharges will quickly link to all parties.

New title dealings by e-dealing

New title dealings can now be carried out via e-dealing. When an Order for New Certificate of Title (OCT) is added as an instrument to an e-dealing in the Create Dealing screen a message displays:

'Signatures and any witnessing by parties must be included in the image attached to this Order for New Certificate of Title'

This message is generic and intended to address all Image Only instruments that do not require certifications. Most of those instruments are notices, consents, certificates or applications. A common example is a s224 certificate.

The message that displays for the OCT states 'any witnessing'. As you are aware, the paper OCT is only ever signed by the solicitor and does not need to be signed by the proprietor, witnessed or signed correct.

Exactly the same applies to e-dealing so simply scan and attach the same paper OCT that you would have used in a paper dealing.

As this is a 'no certifications' instrument, no Authority and Instruction is required.
